General terms of use (AGB)
As of: November 2026
For cooperation with restaurants, the separate partner terms or the individual partner agreement also apply.
1. Provider and scope
1.1 The LieferCH platform (website and functions offered through it) is operated by E&E Digital, Inh. Faruk Ersoy (sole proprietorship), Zollweg 8b, 5034 Suhr AG, Switzerland, e-mail: [email protected] («LieferCH», «we»).
1.2 These terms apply to the use of the platform by customers («you») and, unless otherwise agreed, by restaurants («partner restaurants»).
2. Pilot status
2.1 The platform is in pilot operation. Functions and content may change during the pilot.
2.2 Real orders are only possible at partner restaurants that expressly take part in the pilot.
3. Role of LieferCH as intermediary
3.1 LieferCH is an intermediary platform. LieferCH does not itself sell any food or drinks and is not a party to the purchase contract.
3.2 The contract for food and drinks is concluded directly between you and the respective partner restaurant (Art. 184 ff. CO). LieferCH merely transmits your order to the restaurant.
3.3 The partner restaurant is solely responsible for:
- the food and drinks, their quality and preparation;
- the information on allergens and ingredients;
- compliance with food and hygiene regulations and other legal obligations (e.g. protection of minors when selling alcoholic drinks);
- the prices and their accuracy;
- accepting, preparing and handing over or delivering the order.
3.4 If you have allergies or intolerances, please contact the restaurant directly before ordering.
4. Ordering and payment during the pilot
4.1 You put together your order via the platform, e.g. after scanning a QR code at the table. When you send it, WhatsApp or your e-mail program opens with a pre-filled message that you send directly to the restaurant.
4.2 The order is only deemed accepted once the restaurant confirms or carries it out. The restaurant may refuse an order, e.g. if a dish is not available.
4.3 Payment is currently made directly to the restaurant: on site, on pickup or on delivery by the restaurant (depending on the restaurant in cash, by card or TWINT) or, if the restaurant offers this, online via its own payment provider («Online bezahlen» button on the menu page). LieferCH does not accept payments for restaurants and does not hold any customer funds. Use of LieferCH is free of charge for customers; LieferCH charges them no fees. Any delivery fee is set by the restaurant. Online payment via LieferCH (through a regulated payment provider) is in preparation; these terms will be supplemented before it is introduced.
4.3a During the pilot, delivery is made by the restaurant or its own courier. LieferCH currently provides no delivery services.
4.4 For online payment via a restaurant’s payment link, the restaurant’s payment provider is responsible; its terms apply. Please address questions about payments and refunds directly to the restaurant.
4.5 Please address complaints about food, prices or the execution of the order directly to the restaurant. We are happy to help you get in touch.
5. Terms for partner restaurants during the pilot
5.1 Table QR ordering: first month free.
5.2 Terms thereafter on request; they are agreed individually in writing with each restaurant.
5.3 The restaurant provides LieferCH with correct and up-to-date information (menu, prices, allergens, opening hours) and confirms that it holds the necessary permits.
6. Availability of the platform
We strive for availability with as few interruptions as possible but cannot guarantee it, especially during the pilot. We may change, restrict or discontinue functions at any time.
7. Liability
7.1 LieferCH is not liable for food and drinks, their quality, allergen information, prices or the execution of the order by the restaurant.
7.2 Otherwise, the liability of LieferCH is excluded to the extent permitted by law. Liability for unlawful intent or gross negligence (Art. 100 CO) and mandatory statutory liability remain reserved.
7.3 We accept no liability for the content of linked third-party websites.
8. Obligations of users
You undertake to use the platform only lawfully, not to place false orders and not to transmit any content or data that infringes the rights of third parties.
9. Intellectual property
All rights to the platform, its texts, graphics and the LieferCH brand belong to E&E Digital, Inh. Faruk Ersoy. Brands, logos and content of partner restaurants belong to their respective owners.
10. Data protection
Information on the processing of your personal data can be found in our privacy policy.
11. Changes to these terms
We may amend these terms at any time. The version published on the website at the time of use or order applies.
12. Severability clause
Should any provision of these terms be invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one that comes as close as possible to its economic purpose.
13. Applicable law and place of jurisdiction
13.1 Swiss law applies exclusively, excluding the Vienna Sales Convention (CISG) and the conflict-of-law rules.
13.2 The place of jurisdiction is the operator’s registered office in Suhr AG, Switzerland. Mandatory statutory places of jurisdiction remain reserved, in particular the place of jurisdiction for consumers at their place of residence (Art. 32 CPC).
